These Terms & Conditions (the Terms) govern access to and use of the Last Minute Bookings mobile application, website, and related services (collectively, the Platform). The Platform is operated by Last Minute Bookings, Inc. (referred to as LMB, we, us, or our). By creating an account, listing services, booking an appointment, or otherwise using the Platform, you agree to these Terms.
1. The LMB Marketplace
LMB is a technology marketplace that helps customers discover and book last-minute appointments offered by independent service providers and businesses. Unless expressly stated otherwise, LMB does not provide the underlying beauty, wellness, personal care, or other appointment services. Providers control their services, qualifications, availability, staff, pricing, policies, and performance.
Providers are independent businesses and are not employees, agents, partners, or representatives of LMB. LMB does not guarantee the quality, safety, legality, licensing, suitability, availability, or outcome of any service. Nothing in these Terms limits obligations that cannot lawfully be limited.
2. Eligibility and Accounts
- You must be at least 18 years old and legally able to enter into a contract.
- You must provide accurate, current information and keep your login credentials secure.
- You are responsible for activity conducted through your account and must promptly report suspected unauthorized use.
- Providers must maintain all licenses, permits, insurance, and professional qualifications required for their services and personnel.
3. Listings, Bookings, and Provider Responsibilities
A booking is formed when the Platform confirms the appointment. Listing information may include the service, provider, location, date and time, original listed price, promotional discount, availability, and provider-specific policies. Providers must honor confirmed bookings and accurately describe their services. Customers must arrive on time, provide information reasonably needed to perform the service, and follow lawful safety instructions.
4. Prices, Discounts, Commission, and Processing Fees
Original Service Price. The Original Service Price is the provider’s undiscounted price displayed for the service before any LMB promotion, coupon, provider discount, credit, or other reduction.
Provider commission. For each booking, the provider owes LMB a platform commission equal to 10% of the Original Service Price. The commission is earned when LMB facilitates the booking and is calculated on the Original Service Price even when a discount, coupon, credit, or promotional offer reduces the amount paid by the customer. Unless LMB expressly agrees otherwise in writing, the commission is non-refundable and may be deducted from provider payouts.
Customer Total Price. Before the customer confirms a booking, the Platform will display the total amount the customer is required to pay, including the discounted service price and any mandatory customer-paid processing or platform fees, excluding only charges that may lawfully be shown separately, such as applicable government taxes. A mandatory processing fee will not be introduced only after a lower service price has been advertised.
Payment processing fee. Payments are processed by Stripe or another payment processor. The provider is responsible for the applicable processing fee, calculated using the Original Service Price, even if the customer pays a discounted amount. The provider authorizes LMB and Stripe to deduct that fee from booking proceeds, the provider’s connected account, pending balance, reserve, or future payouts. Stripe may change its rates, and LMB may pass through the actual processing cost and related payment-network charges. LMB does not store full payment-card numbers.
Discount funding. Unless a campaign expressly states that LMB funds a discount, the provider bears the economic cost of every provider-created discount, recovery coupon, promotion, or credit. Discounts and credits may have service, provider, location, expiration, minimum-spend, or single-use restrictions. They are nontransferable, have no cash value, and cannot be combined unless LMB states otherwise.
5. Cancellations, No-Shows, and Provider Changes
Customer cancellations at least 24 hours before the appointment. A customer may cancel a confirmed appointment through the Platform when the cancellation is submitted at least 24 hours before the scheduled appointment time. Any refund resulting from that cancellation remains subject to the non-refundable Stripe processing fee described below.
Customer cancellations within 24 hours of the appointment. Once an appointment is less than 24 hours away, the customer may request cancellation only because of extenuating circumstances. The business owner will review the request first and may approve or deny it. If the business owner denies the request or the matter remains unresolved, the customer may escalate it to LMB customer support. LMB may request supporting information and determine, in its sole reasonable discretion, whether the circumstances warrant cancellation. Except where applicable law requires otherwise, LMB’s determination is final.
Financial responsibility for approved cancellations. If a cancellation results in a refund, the approved refund amount and associated Stripe processing fee will be charged back to the business or deducted from its connected payment account, pending balance, reserve, or future payouts. LMB does not refund, absorb, reimburse, or otherwise incur the Stripe processing fee. A negative business balance remains due to LMB.
If a provider cancels or cannot perform a confirmed service, LMB may help the customer rebook or issue an appropriate refund at the business’s expense. LMB may allow a qualified substitute provider when disclosed to and accepted by the customer.
6. Service Concerns and LMB Resolution Process
This section applies when a customer is dissatisfied with a completed service. LMB provides this process as a customer-support accommodation and marketplace-management tool; it does not make LMB responsible for the underlying service. The process is separate from a bank or card-network chargeback and from the legal dispute process in Section 15.
- The customer must initiate a refund request through the Platform within 24 hours after the scheduled appointment time and select a reason, describe the issue, and provide relevant evidence such as photos or messages. Requests submitted after this deadline may be denied unless applicable law requires otherwise.
- The business owner reviews the refund request first and may approve or deny it. The business owner may communicate through the in-app chat, submit evidence, or offer a coupon for a future service instead of a refund. The coupon must identify the eligible service, discount amount or percentage, eligible provider or staff member, and expiration date. The business is solely responsible for honoring and funding the coupon.
- The customer may accept or decline the coupon. Except where prohibited by law, acceptance constitutes the customer’s full and final resolution of that service concern, and the customer may not also obtain a refund or additional LMB remedy for the same issue.
- If the business owner denies the refund, the customer declines the coupon, or the matter remains unresolved, the customer may escalate it to LMB customer support. LMB may request additional information and review the full record, including the in-app chat.
- In LMB’s sole reasonable discretion, LMB may issue a full refund, partial refund, no refund, request more information, or approve another resolution. LMB may consider the booking record, communications, evidence, provider policies, prior activity, safety issues, cooperation, and applicable law. Except where law requires otherwise, LMB’s decision is final and there is no internal appeal.
- All actions may be timestamped and visible in the administrative record. Fraud or risk flags may trigger additional review but will not, by themselves, automatically determine the outcome.
Refund allocation. When the business owner or LMB customer support approves a refund, the approved refund amount will be charged back to the business or deducted from its connected payment account, pending balance, reserve, or future payouts. Unless required by law, Stripe processing fees and LMB’s commission are non-refundable. The business remains responsible for the Stripe processing fee associated with the original transaction and any other processor or card-network charges. LMB does not refund, absorb, reimburse, or otherwise incur those fees. A customer refund will not exceed the amount the customer actually paid for the affected service, excluding non-refundable fees. A negative business balance remains due to LMB.
7. Chargebacks
Users should first use the LMB Resolution Process for service-quality concerns. Nothing prevents a customer from exercising non-waivable rights with a card issuer. Providers must promptly provide requested records and evidence. The provider is responsible for chargebacks arising from its services, conduct, policies, cancellations, fraud, or failure to respond and authorizes LMB to recover the disputed amount, Stripe or card-network fees, and related costs from any provider funds. LMB may suspend payouts or require a reserve while a chargeback or elevated risk remains unresolved.
8. Reviews, Messages, and User Content
Users may submit reviews, photos, in-app chat messages, dispute evidence, and other content. LMB may access, monitor, preserve, and review communications for support, dispute resolution, safety, fraud prevention, enforcement, and legal compliance. Users retain ownership of their content but grant LMB a worldwide, nonexclusive, royalty-free license to host, reproduce, display, and use it to operate, secure, improve, and promote the Platform, subject to the Privacy Policy.
Content must be truthful, relevant, lawful, and must not infringe another person’s rights or disclose sensitive information without permission.
9. Prohibited Conduct
- Fraud, false claims, payment abuse, harassment, discrimination, threats, or unsafe conduct.
- Circumventing Platform fees or moving a confirmed LMB transaction off-platform.
- Manipulating reviews, discounts, referrals, availability, prices, or dispute records.
- Scraping, reverse engineering, disrupting, or gaining unauthorized access to the Platform.
- Offering or booking unlawful, unlicensed, misleading, or infringing services.
10. Safety and Emergencies
The Platform is not an emergency service. Users should contact emergency services when immediate assistance is required. Customers should independently evaluate whether a provider and service are appropriate for their needs, including allergies, medical conditions, or other risks.
11. Intellectual Property
The Platform, LMB name, logos, design, software, and related content are owned by or licensed to LMB and are protected by applicable laws. Except for the limited right to use the Platform under these Terms, no rights are granted.
12. Suspension and Termination
LMB may investigate, limit, suspend, or terminate access; remove listings or content; hold payouts as permitted by law; or require additional verification when reasonably necessary to protect users, enforce these Terms, prevent fraud, address safety or legal concerns, or maintain the Platform. Users may stop using the Platform at any time, but accrued payment and dispute obligations survive.
13. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED ‘AS IS’ AND ‘AS AVAILABLE.’ LMB DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. LMB DOES NOT WARRANT THAT THE PLATFORM OR ANY PROVIDER SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SAFE, OR SATISFACTORY.
14. Limitation of Liability and Indemnity
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LMB WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, OR THE ACTS OR OMISSIONS OF A PROVIDER OR CUSTOMER. LMB’S AGGREGATE LIABILITY ARISING FROM THE PLATFORM WILL NOT EXCEED THE GREATER OF $100 OR THE PLATFORM FEES PAID TO LMB BY THE CLAIMANT DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations, so they may not apply.
Users agree to indemnify and hold harmless LMB and its affiliates, officers, employees, and agents from third-party claims arising from their services, content, conduct, violation of these Terms, or violation of law, except to the extent caused by LMB’s own unlawful conduct.
15. Legal Disputes
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED INDIVIDUALLY AND LIMITS HOW RELIEF MAY BE SOUGHT.
Before starting arbitration, a party must send written notice describing the claim and requested relief to Info@last-minutebookings.com or by mail to 48 Spurwood Dr, #7483, Star Valley Ranch, WY 83127 and allow 30 days for an informal resolution.
Except for eligible small-claims matters, requests for public injunctive relief to the extent non-waivable, and claims concerning intellectual-property misuse, any dispute arising from the Platform or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules and governed by the Federal Arbitration Act. No party may pursue or participate in a class, collective, consolidated, or representative action, and the arbitrator may award relief only to the individual claimant.
Opting out. Users may opt out of arbitration within 30 days after first accepting these Terms by sending written notice to Info@last-minutebookings.com with the subject line Arbitration Opt-Out. The notice must include the user’s full name, account email, and a clear statement that the user is opting out of arbitration.
California law governs these Terms without regard to conflict-of-law rules. For claims not subject to arbitration, the parties consent to the exclusive jurisdiction of the state and federal courts located in Riverside County, California.
16. Changes to These Terms
LMB may update these Terms. Material changes will be communicated through the Platform, email, or another reasonable method before they take effect when required. Continued use after the effective date constitutes acceptance, except where affirmative consent is legally required.
17. General Terms
If a provision is unenforceable, it will be modified only as necessary and the remaining provisions will continue. Failure to enforce a provision is not a waiver. Users may not assign these Terms without LMB’s consent; LMB may assign them in connection with a merger, financing, reorganization, or sale. These Terms, the Privacy Policy, and policies displayed at booking constitute the agreement regarding the Platform.
